These terms are the agreement between you and JetCircle when you use the JetCircle app or website (the “platform”) to form or join a group and charter an aircraft. Please read them. By using the platform you accept them.

JetCircle arranges flights; it does not fly them. The aircraft is flown by a licensed operator under its own rules. Much of what follows is about who is responsible for what. Above all, each passenger is responsible for themselves.

We are finalising these terms with Nigerian aviation and consumer-protection counsel. This version applies to your use of the platform now, and we will tell you before any material change. Nothing here removes rights you have under Nigerian law, and nothing here is legal advice.

01What JetCircle is, and is not

JetCircle is a broker. We arrange the charter of a whole aircraft between a group of travellers and a licensed Air Operator Certificate (AOC) holder (the “operator”). We do not own, operate, or control any aircraft, and we are not an airline or an air carrier.

You buy a share of a charter, not a seat we priced. Taking a place means agreeing to pay a disclosed share of the cost of chartering the whole aircraft, plus JetCircle’s separately stated arranging fee. It is not a ticket on a scheduled flight.

The operator carries you. The aircraft flies under the operator’s licence and its own conditions of carriage. The operator, not JetCircle, has operational control: the crew, the dispatch, and every decision to depart, divert, delay, or cancel for safety, weather, technical, or regulatory reasons.

Your contract of carriage is with the operator. Your contract for the arranging service is with JetCircle.

02Your account and verification

You must be 18 or older and able to enter a binding contract. You are responsible for your account and for everything done through it. Keep your sign-in secure and do not let anyone else use it.

You verify your own identity. Before a group is confirmed, every person on board must be named, identity-verified, and have signed the current passenger declaration. Nigerian passengers verify by NIN; travel outside Nigeria needs a passport. Anyone you bring as a guest verifies themselves through a private link; you cannot verify on their behalf.

  • You must give accurate, current identity, travel-document, and contact information.
  • A place with no verified, declared passenger against it cannot board.
  • Giving false information may mean the operator cannot carry you, and may be an offence.

03Groups, organizers, and group decisions

Opening a group. Whoever opens a group (the “organizer”) chooses the route, the day, and the aircraft, commits to it first, and pays before anyone else can see or join it. An organizer may make the group open to anyone, or invite-only.

How the cost is shared. A public group is offered at one figure per place: the whole aircraft divided by its places, and every public place costs the same. An invite-only group may use agreed shares, or one person may cover the whole aircraft and hand out places to named guests.

Decisions made together. A group settles shared choices in its cabin: the departure, the return time, seating, catering, and whether to cover a shortfall. Where the group or the organizer makes such a choice, it binds the places in that group. If you do not accept a group’s shared arrangements, do not join it, or leave before the cut-off.

Seating. On aircraft with assigned seating, seats are chosen from a shared map; a seat another passenger has taken is not available to you. Final seating may be adjusted by the operator or crew for weight, balance, or safety.

Organizers are members, not agents of JetCircle. An organizer arranges a trip for their group; they do not act for JetCircle and cannot bind JetCircle or the operator beyond what the platform provides.

04The price, payments, and your money held

The price is shown in full. The operator’s charge and JetCircle’s arranging fee appear as two clear lines before you pay, together with the price per place. Nothing is payable until a price is published. Prices are shown and paid in Nigerian Naira. Any statutory charges or taxes that fall on the flight are disclosed.

Your money is held, not spent. When you take a place, we hold the place for you and your payment is held, shown in the app as “payment accepted, awaiting group confirmation.” It is not released to the operator until the charter is confirmed. JetCircle does not run spendable wallets, credit balances, or interest-bearing accounts; money is held against a specific flight.

Covering a shortfall is optional. Before the cut-off, members may choose to top up beyond their own place to help save a flight. A top-up is voluntary and a place still costs what a place costs. If the group is cancelled, top-ups are refunded in full.

05Confirmation, cancellations, and refunds

All or nothing at the cut-off. Each group has a cut-off. If it is fully funded by then, the charter is confirmed and the operator is paid. If it is short at the cut-off, the group is cancelled and every member is refunded in full. You never pay for an empty plane.

If the group does not fill. You get back everything you paid, your place and any top-up, with no cancellation charge for a flight that does not happen. We aim to refund on the same day, and in every case within the time the law requires, to your original payment channel.

If you cancel after a charter is confirmed. Once confirmed, your share pays for a committed aircraft. You may cancel, but a reasonable charge may apply, based only on costs that cannot actually be recovered, on a published scale that rises closer to departure. Where your place is resold, the matching amount is credited back. No charge applies where you cannot travel because of death or hospitalisation, as the law provides.

If the operator cancels or changes the flight. Where the operator cancels, swaps the aircraft, or materially changes the flight, we will tell you promptly and either arrange an alternative or refund you in full for any part not delivered.

Events beyond control. Neither JetCircle nor the operator is liable for failure or delay caused by events beyond reasonable control: weather, technical faults, airspace or airport closures, regulatory action, unrest, or similar “extraordinary circumstances.” This does not remove your right to a refund for a service not delivered.

06Each passenger carries their own responsibility

On JetCircle, each passenger carries their own cross. You are individually responsible for yourself and for anyone you bring as your guest.

  • Your actions and conduct:how you behave on the platform, at the airport, and on board.
  • Your documents:valid identity, passport, visas, permits, and any health or entry requirements for your trip.
  • Your payments:paying your own share correctly and on time, from an account in your own name.
  • Your baggage and belongings:what you pack and carry, and keeping it within the operator’s limits.
  • Your compliance:with all applicable laws, aviation and airline rules, the operator’s conditions of carriage, airport requirements, customs and immigration, and security and screening procedures.
  • Your guests:anyone you add travels on your invitation, and you are responsible for their eligibility, information, and conduct as if your own.

Responsibility does not pass between passengers. Each passenger is responsible for their own conduct alone. One passenger’s act, omission, or misconduct does not make another passenger responsible, and does not make JetCircle responsible. JetCircle is not liable for what any passenger or guest does, and sharing a cabin with someone does not make you, or us, answerable for them.

If your conduct or your guest’s causes loss, delay, diversion, a refusal to carry, a fine, or damage, the responsibility and any cost sit with you, not with the group or with JetCircle.

07Baggage, prohibited items, and security

You must bring no dangerous goods and must stay within the operator’s baggage limits, as confirmed in your passenger declaration. Prohibited and restricted items are set by the operator, by aviation rules, and by airport security, and those rules override any group arrangement.

  • You are responsible for your own baggage and personal belongings at all times.
  • You must complete security and screening as required; the operator or authorities may refuse to carry anyone or anything that fails it.
  • Liability for baggage in the course of carriage sits with the operator under the applicable carriage rules and its insurance.

08Flights, delays, waiting time, and emergencies

Operational control is the operator’s. Departure, routing, delays, diversions, and cancellations for operational, safety, weather, or regulatory reasons are the operator’s decisions, made by its crew. Published times are planning times and may change.

Waiting time (return trips). On a same-day return, only the passengers flying home share the cost of holding the aircraft on the ground, split evenly between them at the operator’s rate, with no JetCircle fee. Waiting funded in advance but not used is refunded after the flight. Passengers who have already flown home are never billed for waiting.

Emergencies. In any emergency, follow the crew’s instructions and the operator’s safety procedures. The crew’s authority on board is final.

09Conduct, the cabin, and networking

Each group has a cabin: the people on board, a pre-flight chat, and optional networking. Use it respectfully and lawfully. Direct messaging between members is off by default and only available where a member has chosen to allow it; do not use anyone’s details for marketing or spam.

We may remove content, or suspend or remove a member, for abuse, harassment, unlawful conduct, false information, or breach of these terms. A suspended member keeps the places and money they already hold; suspension stops what is next, not what is done.

10Liability: what we are, and are not, responsible for

Carriage liability (death, injury, delay, and baggage in the course of carriage) sits with the operator under its licence, the applicable international carriage rules (including the Montreal Convention as applied in Nigeria), and its insurance. Nothing in these terms excludes any liability that the law does not allow to be excluded.

JetCircle is responsible for

Our own service

  • Arranging the charter with a properly licensed operator.
  • Showing the price in full, with the fee stated separately.
  • Holding your money and refunding it as set out here.
  • Handling your data lawfully and keeping the platform running with reasonable care.
JetCircle is not responsible for

Things outside our service

  • Operating the aircraft, or any flight decision: those are the operator’s.
  • Any passenger’s or guest’s acts, omissions, conduct, documents, or belongings.
  • Loss or delay from events beyond reasonable control.
  • Indirect or consequential loss, to the fullest extent the law allows.

Where JetCircle is liable for its arranging service, our total liability is limited, to the extent the law allows, to the arranging fee you paid for the booking concerned. This does not limit anything that cannot lawfully be limited.

11Privacy and your data

We process your personal data, including identity, travel-document, and payment data, in line with the Nigeria Data Protection Act and our Privacy Policy. By taking a place, you agree that your manifest and travel-document data may be shared with the operator and, where required, with border and immigration authorities, so that you can be carried lawfully. We do not show your identity documents to other members.

12Account misuse, fraud, and prohibited use

You must use JetCircle honestly. The following are prohibited and may lead to suspension, removal, loss of access, reversal of a place, and reporting to the authorities:

  • Fraud, payment fraud, money laundering, or paying from an account that is not your own.
  • Impersonation, false identity or documents, or verifying on someone else’s behalf.
  • Chargeback abuse, or reversing a payment for a service that was delivered.
  • Automated access, scraping, probing, or interfering with the platform’s security.
  • Using the platform for anything unlawful, or to carry anyone or anything not permitted.

We may hold, review, or decline a booking, and share information with the operator or authorities, where we reasonably suspect fraud, a security risk, or a breach of these terms.

13Disputes, governing law, and complaints

These terms and any contract under them are governed by Nigerian law. Please raise any problem with us first, at [email protected]; most things are resolved quickly. You may also complain to the NCAA Consumer Protection Directorate or the FCCPC, or go to court; nothing here removes those rights.

14Changes to these terms

We may update these terms; the current version and its date are shown at the top. Where a change materially affects a booking you have already made, we will tell you, and your rights under the law are unaffected.
